David Applebaum's practice focuses on energy industry enforcement, compliance, internal investigations, audits, litigation, regulatory, and policy matters. He regularly advises on proposed energy market transactions to mitigate enforcement risk from FERC (Federal Energy Regulatory Commission), CFTC(Commodity Futures Trading Commission), NERC (North American Electric Reliability Corporation), state public utility commissions (PUCs), antitrust enforcers, and RTO (Regional Transmission Organization) market monitors. David has successfully represented clients on a broad range of enforcement investigations and surveillance inquiries alleging market manipulation.

David is the former head of FERC's Division of Investigations, where he managed all aspects of the Division, including decisions on opening, conducting,and resolving investigations, settlements, enforcement actions, trials, and electric reliability inquiries. He also led the Division in coordination efforts with the CFTC on market manipulation investigations. During his government service, David was a member of the Office of Enforcement senior management team and was a key advisor to Commissioners' Offices and senior staff on enforcement matters.

Before joining FERC, David was in private practice, focusing on antitrust, class action, and financial services litigation for corporate clients.

Kelsey A. Bagot is currently serving as the 39th Commissioner of the Virginia State Corporation Commission ("Virginia SCC") after her election by the General Assembly in 2024. Judge Bagot is one of three Commissioners at the Virginia SCC, an independent state agency responsible for regulating public utilities, insurance, state-chartered financial institutions, securities, retail franchising, and railroads. The SCC is also Virginia’s central filing office for corporations, limited partnerships, and limited liability companies and operates Virginia’s Health Benefit Exchange.

Prior to being elected to the Commission, Judge Bagot was a Senior Attorney at NextEra Energy, Inc., where she worked on a variety of federal and state regulatory and compliance issues facing one of the nation’s largest electric utilities. Prior to this, she served as Legal Advisor to Commissioner Mark C. Christie at the Federal Energy Regulatory Commission ("FERC") and as a trial attorney in FERC’s Office of Administrative Litigation, where she routinely addressed interstate energy topics. Early in her career, Judge Bagot also spent several years as an associate focusing on regulatory and administrative matters at Troutman Pepper LLP and Van Ness Feldman LLP in Washington, DC.

Judge Bagot earned her Bachelor’s Degree from American University and her Juris Doctor from Harvard Law School. She currently resides on a small farm in Warrenton, Virginia with her husband, two dogs, and a menagerie of other “pasture pets.”

William has also represented energy clients in criminal investigations by the U.S. Department of Justice and in investigations by other agencies.

William has represented clients in complex litigation before FERC, state utility commissions, arbitral tribunals, and trial and appellate courts. His experience as a litigator gives him a unique insight into complex commercial disputes of all kinds.

Jennifer Berrier is the Executive Director at the Pennsylvania Public Utility Commission, where she manages the day-to-day operations of its offices and bureaus administering and enforcing the Pennsylvania Public Utility Code. The Commission oversees more than 8,400 entities providing utility services across Pennsylvania, including electricity, natural gas, water and wastewater, motor carrier transportation, railroad crossings, and telecommunications.

Prior to joining the Commission, Jennifer was appointed by former Governor Wolf to serve as Secretary of the Pennsylvania Department of Labor & Industry, where she oversaw programs and services that safeguard and promote the well-being of Pennsylvania’s workers and businesses. She was appointed to that position after a long career in the department serving as a deputy secretary, bureau director, and legal counsel for labor and employment matters.

Jennifer earned her Juris Doctor from Widener University and is admitted to practice in Pennsylvania.

Jonathan Brightbill is General Counsel of the U.S. Department of Energy. He is a graduate of the Georgetown University Law Center and the University of Pennsylvania Wharton School of Business. Mr. Brightbill clerked for the Honorable D. Brooks Smith on the United
States Court of Appeals for the Third Circuit.

As General Counsel, Mr. Brightbill is responsible for overseeing the legal operations of the Department of Energy, as well as counseling
the Secretary, Deputy Secretary and senior leadership on the execution of their duties in the development of federal energy policy. His oversight portfolio includes nuclear energy regulatory reforms, electricity and gas markets, energy efficiency, civilian nuclear programs, business transactions, international negotiations, loan and grant investments, and oversight of the Department’s national laboratory system.

Prior to joining DOE, Mr. Brightbill was a partner in the Washington, D.C. office of Winston & Strawn. During the first Trump administration, he served as Acting Assistant Attorney General for the Environment & Natural Resources Division of the U.S. Department of Justice. Mr. Brightbill was previously a partner in the Washington, D.C. office of Kirkland & Ellis. Mr. Brightbill has also taught as an adjunct professor at Georgetown University Law Center.

Ms. Calwell chairs the International Confederation of Energy Regulators’ Technology & Innovation working group, participates in the CAMPUT executive and is the President of the Canadian Chapter, Energy Bar Association.

Previously, she served as General Counsel & Parliamentarian for the Committee on Ways and Means, where she handled all legal and procedural issues for the Committee. Before that, she was the Oversight Staff Director at the Committee where she led the investigations and oversight of all issues within the Committee’s jurisdiction. Prior to joining Ways and Means, she served as the Director of Oversight and Investigations for the Committee on Oversight and Government Reform and as Senior Oversight Counsel at the Committee on Natural Resources.

Previously, Machalagh served in the Office of Global Compliance of an international energy company where she conducted internal anti-corruption investigations, audits, and compliance reviews for the company. Before her in-house experience she practiced in the Litigation, White Collar, and Government Investigations Group at Sonnenschein Nath and Rosenthal LLP (now Dentons). Directly after law school, Machalagh clerked for the Chief Judge of the U.S. Court of Appeals for the Armed Forces.

She taught Trial Practice at Catholic University of America, Columbus School of Law and lives in Virginia with her husband and three sons.

Neil Chatterjee is Chief Governmental Affairs Officer for Palmetto Solar. He was a former Commissioner and Chairman of the Federal Energy Regulatory Commission (FERC), and has deep ties in Washington and across the industry, with extensive experience across the energy landscape both domestically and internationally. He is respected for his ability to strike compromise and work with a wide variety of stakeholders.

In his time on the Hill and at FERC, Neil built a reputation as a bipartisan operator who builds alliances and cuts through red tape with an eye on always promoting innovation. Neil’s significant knowledge and experience is derived from operating at the highest levels of government and as such, is able to provide clients valuable insights and counsel when navigating the highly regulated energy industry.

While at FERC, Neil championed several strategic initiatives, including streamlining and improving FERC’s liquified natural gas application review and approval process, bolstering power grid reliability and resilience, and boosting renewable resources’ ability to compete in regional power markets and for the reduction of carbon emissions.

Neil is a policy reformer who broke down market barriers for the entrance of new technologies, particularly for low-carbon technologies. He has been an advocate for harnessing technology to mitigate physical and cyber threats to critical energy infrastructure.

Prior to his time at the Commission, Neil served as an advisor to Sen. Mitch McConnell (R-KY) where he aided in the passage of major energy, highway, and agriculture legislation. Neil also has experience working as a principal in government relations for the National Rural Electric Cooperative Association. He began his career as a staff member on the House Committee on Ways and Means.

She previously served in the Oklahoma State Senate from 2010 to 2022, where she was the first woman since statehood to be named majority leader, the first woman to chair the Senate Appropriations Committee, and the first Republican woman to serve as majority whip.

Chairman David is a native Oklahoman, a dedicated spouse, a military mother, and caring grandmother to three boys. She is a successful small business owner who manages multiple properties. She is a proud Cowboy and holds a Bachelor of Science in Petroleum Geology from Oklahoma State University.

In addition to serving as Chairman of the Corporation Commission, she also serves as Oklahoma’s voting member on the Southwest Power Pool’s Regional State Committee. She is a member of the board at the National Association of Regulatory Utility Commissioners, where she serves on the Committee on Electricity, the Committee on Gas, the Chair of the Subcommittee on Pipeline Safety, and was appointed to the National Petroleum Council. Kellie served on the U.S. Senate Energy and Natural Resources Committee for 17 years, most recently as Chief Counsel. During her time with the committee she provided counsel on all energy policy and federal land issues within its vast jurisdiction. She also helped negotiate, draft, and enact everything from major legislative packages and budget reconciliations measures, to targeted provisions and stand-alone bills.

Previously Kellie was an attorney in private practice with Sullivan & Worcester, as well as Verner Liipfert. Earlier in her career, she worked as a Counsel for the U.S. Interior Department and the U.S. Senate Environment and Public Works Committee.

Kellie holds a J.D. from the Columbus School of Law, Catholic University of America and a B.A. from The College of the Holy Cross. Kim Duffley serves as the Senior Director of Energy Policy and Legal Counsel for the National Association of Regulatory Utility Commissioners (NARUC). In this role, she engages with the member state public utility commissions (PUCs) in policy efforts relating to energy issues and engages with federal bodies to promote NARUC’s mission. She also is legal counsel in energy-related filings at federal agencies and in federal courts.

Duffley joined NARUC after more than 25 years working for the State of North Carolina. Before joining NARUC, she served as a Commissioner for the North Carolina Utilities Commission from 2019 to 2025. During her tenure, she served as Chair of the Electricity Committee of NARUC, Member of the Board of Directors of NARUC, Co-Chair of both the Joint Federal-State Task Force on Transmission and the Federal and State Current Issues Collaborative, Member of the EPRI Advisory Board, and Board Member of OPSI, among other roles. In addition to her role at NARUC, she is currently on the Advisory Board of the UNC-Chapel Hill Kenan-Flagler Energy Center.

Prior to his current position, Mr. Farmer has held a variety of senior roles at the IESO and Ontario Power Authority in the areas of Power System Planning, Conservation, and Corporate Relations. His career began with Union Gas where he focused on the residential and commercial markets, and was Director for Market Knowledge and Demand Side Management.

Mr. Farmer is a graduate of the Richard Ivey School of Business at The University of Western Ontario.

Andrew Giles Fay is Of Counsel in Greenberg Traurig's Tallahassee office. A former Chairman (2022-2024) and Commissioner (2018-2026) of the Florida Public Service Commission, Andrew brings deep experience in utility regulation, energy policy, and government decision making at the intersection of law, finance, and technology. He focuses on the regulatory implications that emerging technologies have on critical infrastructure, including the use of artificial intelligence and cybersecurity compliance.

Before the Commission, Andrew served in the Office of the Florida Attorney General as Special Counsel to Attorney General Pam Bondi. Andrew brings substantial legislative branch experience from his time in the Florida Attorney General's Office. He successfully advocated for the passage of more than a dozen significant legislative initiatives, most notably serving as the lead author and advocate of Florida's Information Protection Act.

Andrew has wide-ranging public finance and bond oversight experience from his service in Florida state government. He advised on the review and issuance of major state bond financings across transportation, education, and state facility projects, including transactions structured as refundings to reduce long-term debt costs.

Kristen has over 20 years of experience with energy market regulation. Kristen’s previous roles at the Commission include serving as an economist, and then as a manager, in the Office of Energy Market Regulation, and serving as the Deputy Director of the Division of Audits and Accounting. Kristen has a bachelor’s degree in Economics from Penn State University, and a master’s degree in Accounting and Business Advisory Services from Towson University. Kristen is a Certified Public Accountant licensed in the state of Maryland and is a recipient of the 2014 Elijah Watt Sells Award.

Patricia M. French is an energy attorney, mediator and neutral, having just concluded a seven-year tenure (2018-2025) as an Administrative Law Judge, initially appointed by the Federal Energy Regulatory Commission under FERC Chairman Kevin J. McIntyre. Prior to her FERC appointment, she had returned to New England and was a shareholder in the Energy and Environmental Practice Group of Bernstein Shur Sawyer & Nelson LLC in Portland, Maine. Before that, she was Chief Compliance Officer and Division Counsel for Columbia Pipeline Group in Houston, Texas, after having served as Vice President, Assistant General Counsel and Chief Compliance Officer for Kern River Gas Transmission Co., a Berkshire Hathaway Energy subsidiary, in Salt Lake City, Utah. Earlier in her career, among other positions, she worked cross-jurisdictionally on regulatory matters for the NiSource Inc. utilities.

The former Judge French earned a juris doctor with honors from the Boston University School of Law. Her undergraduate degree is from Wells College (now Hobart and William Smith College). She is admitted to practice law in and before the courts of Massachusetts, Connecticut, Rhode Island, New Hampshire, Maine, Utah, and the District of Columbia; the U.S. District Courts of Massachusetts, New Hampshire and Utah; and the U.S. Court of Appeals for the First Circuit and the DC Circuit.

Lucas Fykes is Senior Director of Energy Policy and Regulatory Counsel for the Data Center Coalition (DCC), the membership association serving as the voice of the data center industry.

Lucas leads DCC’s state regulatory engagement on large-load tariffs, cost allocation, rate design, and related customer protection mechanisms. He works closely with DCC members to set strategy and develop filings in major utility proceedings nationwide, including contested cases and settlement tracks. Lucas directs DCC’s outside counsel and expert witnesses and works closely with members to develop consistent, practical positions and regulatory messaging on behalf of the industry. Lucas also supports DCC’s broader energy policy advocacy nationwide, including work with stakeholders on grid planning, market design, and policies to enable reliable, timely infrastructure investment. He regularly speaks at conferences and industry engagements on behalf of DCC on the data center industry, large-load growth, tariff design, and grid modernization.

Before joining DCC, Lucas represented community choice aggregation providers, clean energy companies, utilities, and retail electric suppliers in administrative litigation, rulemakings, and other regulatory matters. His practice included counseling clients on energy and utility law issues, distributed energy resource policy, and electric and natural gas procurement for commercial, governmental, and residential customers. Lucas has appeared before the Public Utilities Commission of Ohio, Illinois Commerce Commission, Georgia Public Service Commission, Public Utility Commission of Texas, Public Service Commission of Wisconsin, and California Public Utilities Commission.

Lucas previously served as Chair of the Columbus Bar Association Energy Law Committee, the Ohio Liaison for the Energy Bar Association’s Midwest Chapter, and a member of the Energy Bar Association’s Taskforce on Law Students, Young Professionals, and Diversity.

Stephanie Rose Grumet is a VC investor in polymetallic nodule harvesting, commonly known as the deep-sea mining (DSM) space. She has served as a strategic advisor with Mineral Harvesting Capital, an SPV raising funds for privately held DSM companies with leases in the Cook Islands. She supported the capital raise and advised on strategies to manage environmental impacts, sustainability and public perception of the risks and benefits of DSM. She recently served as Senior Policy Advisor in the U.S. Environmental Protection Agency, leading the development of regulatory policies spanning power sector emissions and PFAS in collaboration with key stakeholders. Previously, Stephanie served as the Director of Climate Strategies and Sustainability at Capstone LLC, a DC-based financial services firm, where she led regulatory due diligence for private equity investors in the energy sector and developed thematic and bespoke research for equity and distressed debt clients. A collaborative leader with more than 30 years of experience shaping and evaluating energy and environmental policy, she advises investors at the nexus of environmental regulation and financial markets. Stephanie earned a bachelor’s degree in mathematics from the University of Wisconsin, and a master’s degree in environmental science from University of Virginia.

Arya Hariharan is currently the Chief Oversight Counsel for the Senate Judiciary Committee under Ranking Member Dick Durbin (D-IL). Kempic previously served as President and Chief Operating Officer of Columbia Gas of Massachusetts, responsible for the company’s day-to-day operation. He was the lead executive in all aspects of the restoration efforts in the Merrimack Valley and helped guide leadership and employees through the sale of the company.

Kempic began his career with Columbia Gas in 1979 and served in roles of increasing responsibility. He served as NiSource’s Chief Transformation Officer and a member of the Executive Council, where he built on NiSource's efforts to integrate processes and technology across the company's entire footprint.

In 2006, Kempic was named assistant general counsel for NiSource Corporate Services, where he managed staff providing legal support in multiple jurisdictions and advised the subsidiary presidents and their teams on various regulatory and legal matters. Earlier in his career, he represented large industrial electricity and gas consumers as an associate attorney for a Columbus, Ohio, law firm and was a regulatory counsel for a Cleveland electric company.

He currently serves on the boards of the American Red Cross of Southwestern Pennsylvania and the Humane Animal Rescue of Pittsburgh. Soo Jin Kim is the vice president of Registration and Standards. Throughout her time at NERC, Ms. Kim has worked on numerous initiatives involving Standards, Compliance, and coordination across the ERO Enterprise. From 2020 to 2023, she served as director of Power Risk Issues and Strategic Management (PRISM) where she transformed the group into a cross-cutting department that serves as technical advisors to other NERC functions. Under her leadership, PRISM initiated several projects to tackle energy assurance risks, particularly those addressing extreme weather challenges. Most notably, her team was instrumental in the formation of the Energy Reliability Assessment Task Force and the efforts to provide the technical support for registering new inverter-based resources. She also works with the Reliability Issues Steering Committee, and she was an integral leader in planning and executing the 2023 NERC Leadership Summit.

Prior to joining NERC, Ms. Kim was an associate at Troutman Sanders LLP in Washington, D.C. in their Energy Practice. John Moura joined NERC in 2008 and is NERC’s director of Reliability Assessment and Performance Analysis. He leads NERC’s efforts to assess and report on the reliability, adequacy, and associated risks to the North American bulk power system (BPS). Mr. Moura oversees the development of NERC’s annual long-term and seasonal reliability assessments —a primary statutory obligation identified in the 2005 Energy Policy Act— as well as evaluating system performance, resilience, event analysis and system forensics, critical infrastructure interdependencies, and emerging issues facing the North American BPS. He has extensive experience in cultivating relationships within the North American electric industry, government and leading experts on BPS reliability, informing and educating key policy makers at federal, state, and provincial levels. Mr. Moura also coordinates the efforts of NERC’s Reliability and Security Technical Committee and other stakeholder groups, bringing together the industry’s expertise on electric system operations, resource and transmission planning, and cyber and physical security.

Throughout his career, Mr. Moura has been dedicated to improving and safeguarding the grid and has been instrumental in advancing NERC’s mission as the Electric Reliability Organization by co-authoring numerous special reports and technical publications.

Nick Myers serves as the Chairman of the Arizona Corporation Commission (ACC). He was elected to the Commission in 2022, bringing a background in software engineering, entrepreneurship, and regulatory advocacy following a significant dispute with a utility company. He is the first commissioner elected from Pinal County.

Upon being sworn into office, Myers’ first official act was to open a docket to modernize Arizona’s rate-making process—a move that set the tone for his term. This initiative ultimately led to the Commission’s adoption of a Formula Rate Plan Policy in 2024, which streamlines the rate setting process, reduces regulatory lag, and improves transparency for the Commission, stakeholders, and customers.

Myers has also led efforts to strengthen Arizona’s long-term energy resilience. In early 2025, he launched formal inquiries into expanding both natural gas infrastructure and nuclear energy generation in Arizona, aimed at ensuring a stable, diversified, and reliable energy mix to support the state’s growing population and economic development.

A strong advocate for customers, Myers has consistently proposed and supported amendments that reduce rate increases. He has also prioritized eliminating unnecessary subsidies that increase rates, such as electric vehicle infrastructure charges from utility programs.

Another key priority for Myers since being elected has been increasing regulatory stability at the ACC. Through consistent rulings, not “changing the rules in the middle of the game,” and prioritizing ratemaking (rather than tangential policies), Myers and his fellow commissioners have significantly improved Arizona’s regulatory environment since 2023.

At the regional level, Myers plays a leading role in shaping energy market design across the Western United States. In 2024, he was elected Chairman of the Markets+ State Committee, composed of regulators from 13 Western states. In this role, he has been central to ensuring state interests are embedded in the market development, governance, and operation of Markets+, a real-time and day-ahead regional energy market operated by Southwest Power Pool, expected to go live in 2027.

At the national level, Myers serves in various capacities. He was most recently appointed to the Federal-State Current Issues Collaborative with FERC and NARUC, representing the West. He also serves in the National Association of Regulatory Utility Commissioners (NARUC), as a member of the Committee on Gas and the Committee on Critical Infrastructure. O'Guinn then began her career as an environmental engineer for the Oklahoma Department of Environmental Quality. She returned to Arkansas to work in the Arkansas Department of Environmental Quality (ADEQ). O'Guinn remained at the ADEQ for 16 years, working as an environmental engineer and later as the director of communications.

She’s held leadership roles with Entergy Regional State Committee, the Organization of MISO States, SPP’s RSC, the National Association of Regulatory Utility Commissioners, the Electric Power Research Institute Advisory Council, Women’s Foundation of Arkansas, the American Association of Blacks in Energy and Arkansas Women in Power. She earned a Bachelor of Science in environmental engineering from the University of Oklahoma.

On Feb. 18, 2026, Governor Gavin Newsom designated John Reynolds President of the California Public Utilities Commission (CPUC), effective March 9, 2026. President Reynolds was appointed to the CPUC by Governor Newsom on Dec. 23, 2021, and reappointed on Dec. 22, 2022.

President Reynolds has experience in both the public and private sector as an attorney and policy advisor in the energy, telecommunications, transportation, and water industries.

President Reynolds earned a bachelor’s degree from Brown University, and a juris doctor degree from the University of California, San Francisco College of Law, where he graduated magna cum laude.

Paul Suskie is the Executive Vice-President of Regulatory Policy, General Counsel, and Corporate Secretary for Southwest Power Pool, Inc. (SPP). SPP is a non-profit designated by the Federal Energy Regulatory Commission (FERC) to serve as the Regional Transmission Organization (RTO) in eleven states. As an RTO, SPP is mandated by the FERC to ensure reliable supplies of power, adequate transmission infrastructure, and competitive wholesale prices of electricity in thirteen states. As a part of these mandates, SPP oversaw wholesale energy and transmission markets with transactions totaling more than $50 billion in 2024 and launched a new Western Energy Imbalance Service Market (WEIS) in 2021. On April 1, 2026, the WEIS Market transitioned to the RTO with SPP becoming the first market operator on both sides of the East-West Interconnections.

Prior to joining SPP, Suskie was appointed by Governor Mike Beebe, to the Arkansas Public Service Commission as Chairman and as member of the Governor’s cabinet. During Suskie’s tenure on the Commission, he served in several leadership roles as a state regulator and was named to Arkansas Business's Top 40 under 40 list of individuals influencing business in Arkansas.

When appointed to the Commission, Suskie was serving in his third elected term as North Little Rock’s City Attorney. North Little Rock has the state’s largest municipally run electric utility provider. While City Attorney, his office received numerous state and national awards for successfully addressing crime ridden neighborhoods through the use of civil nuisance abatement laws.

Before joining the North Little Rock City Attorney’s office, Suskie worked for former United States Senator David Pryor in Pryor’s Washington and Little Rock offices and was law clerk for Arkansas Attorney General Winston Bryant.

Suskie is a graduate of the University of Central Arkansas, the University of Arkansas at Little Rock School of Law, and the Harvard Business School’s Advanced Management Program. He is a retired Colonel who served over 20 years in the U.S. Army’s JAG Corp. During his military career he was appointed a state military judge and is a veteran of both the wars in Afghanistan and Iraq. In 2005, Suskie served a tour in Afghanistan and in 2008 he served a tour in Iraq with the 39th Infantry Brigade Combat Team.

Dr. White’s public service includes appointments as a senior economist at the U.S. Federal Energy Regulatory Commission and the U.S Federal Trade Commission, and as a member of the Technology Advisory Committee to the U.S. Commodity Futures Trading Commission.

Dr. White’s work centers on energy markets and electricity market design, including market microstructure, pricing practices, and demand analysis. His studies appear in leading research journals, including the Review of Economic Studies, the RAND Journal of Economics, the Review of Economics and Statistics, and the Brookings Papers on Economic Activity. He has served as an evaluator and referee for more than 25 peer-reviewed journals spanning economics, engineering, and political science. Kenneth W. Yagelski is the Director of Gas Supply for Southern Company Gas (NYSE: SO). He also leads the company’s business advocacy before the Federal Energy Regulatory Commission, representing the interests of Southern Company Gas’s local distribution companies.

Ken earned a Bachelor of Science in Electrical Engineering from Purdue University, where he focused on power systems, and pursued graduate studies in business at the University of Illinois Springfield. He brings extensive experience across the natural gas and electric power sectors, having previously held management roles with UGI Energy Services, Washington Gas, and Illinois Power (now Ameren), as well as serving as a consultant to the North American energy industry. His responsibilities have spanned system and resource planning, business development, supply sourcing, asset optimization, engineering, information technology, and regulatory affairs at both the state and federal levels.

Ken has served as an expert witness in regulatory and legal proceedings, presented at government hearings, and taught and spoken widely on energy industry issues.
