9:45 – 11:00 AM: Transmission Panel – Order No. 1920 Compliance and Appellate Review in the Northeast

Lead counsel for the New York Transmission Owners, PJM Transmission Owners, a representative of the New England Transmission Owners, and the lead transmission siting regulator of the State of the Connecticut will together consider the compliance plans and obligations to implement Long-Term Regional Transmission Planning in the Northeast.  FERC Order No. 1920 is proceeding in a consolidated appeal in the 4th Circuit Court of Appeals located in Richmond, Virginia.  The Speakers may consider the legal durability of the final rule and its fate on appeal.

Forward capacity markets have been in operation for nearly 20 years, and have been largely successful in sending competitive market price signals to carry out the markets’ core mission of incentivizing new generation to come on line and uneconomic generation to leave the system. The capacity markets have not been without changes over the years to capture changing needs and conditions. With the changing fleet, the increasing frequency of “100 year” events, the proliferation of large loads driven by data centers and electrification, there’s continued focus on capacity market reform. In this panel, we will hear from experts who will explore several current issues that are or will be on the table for discussion in the near term, such as accreditation, sub-annual capacity products, and the shape and height of the demand curve.

President Trump’s removal of National Labor Relations Board member Gwynne Wilcox has faced significant legal challenges in different courts.  Speakers will consider the potential outcome and consequences of this litigation, particularly on how the U.S. Supreme Court’s forthcoming opinion on the matter may affect the President’s authority over commissioners of the Federal Energy Regulatory Commission and Nuclear Regulatory Commission.

3:45 – 5:00 PM: Cross-Border Electricity Tariff Issues at the U.S. Canadian Border

In reaction to a potential trade war between the United States of America and Canada, which may include the imposition of tariffs on electricity imports and exports at the northern border, ISO New England Inc. and the New York Independent System Operator have each obtained approval by FERC to implement measures to collect import export duties on cross-border electric transactions.  This incredible group will consider the implications of electricity import export tariffs and to what extent power can feasibly cease to flow between the two countries.
